PRINT SHOP TERMS AND CONDITIONS

Please see our terms and conditions outlined below, and which govern the access and purchase of artwork through the Jessica Bucci print shop. 

Please read carefully, as it will affect your legal rights. 

The terms and conditions apply between you, the User, and Jessica Bucci, the owner of all the artwork copyright. By agreeing to these terms, User confirms that they have the authority to bind any business on whose behalf they access the print shop. 

ACCESS

In order to view or purchase any artwork, User will need to receive a password. This password is only available to trade/business customers, and we reserve the right to decline a password request or suspend access at any time. User must use commercially reasonable efforts to prevent unauthorized access. We reserve the right to update or remove a password at any time. 

ORDER PROCESS

The advertising of images on our website constitutes an “invitation to treat” rather than a contractual offer. No contract will come into force between User and Jessica Bucci, unless the order is accepted in accordance to the following procedure. 

To enter into a sales contract to purchase digital artwork from us, the following steps must be taken:

1.        User must contact us  via email with the article number(s) of the artwork you wish to purchase. 

2.        User will then receive a contract outlining price and usage terms and conditions, to be signed by both parties. 

3.        Upon signing, User will be sent an invoice. 

4.        Upon payment, User will be sent the purchased artwork.

AMENDING OR CANCELLING AN ORDER

All sales are final upon receipt of purchased artwork. If User wishes to amend or cancel an order before the artwork has been received, contact us immediately. 

PRICES

All prices are quoted on our website in USD. All amounts stated on our website are exclusive of VAT, local sales tax, or similar taxes. User will be charged VAT at checkout if an EU registered company. VAT will be outlined on the invoice where appropriate. If any tax is levied on a payment to us, it is your responsibility to inform and reimburse us of any deduction. 

COPYRIGHT

Title to any artworks will not pass to User until we have received payment in full. Any copyright transfer forms requiring a signature from us should be sent via email. They will be signed by the appropriate party and returned via email or post where appropriate. 

DELIVERY

User must inspect the digital files on downloading. If User identifies any errors, they must inform us via email within 10 days of receipt, providing details.  We will rectify any errors.

All sales are final, with no returns or exchanges. 

We will be under no liability or further obligation to the artworks if:

1.        You fail to provide notice as outlined above and/or

2.        A defect arises from misuse or alteration of the artworks, negligence, willful damage, or any other act by you, your employees, agents, or any third parties and/or

3.        Your insolvency or possible insolvency.

INTELLECTUAL PROPERTY TRANSFER AND ACCEPTABLE USE

All content, rights, and interest included in this portfolio is the property of Jessica Bucci. Content means any text, graphics, images, software, data compilations, page layout, underlying code and software, and any other form of information capable of being stored in a computer that appears on, or forms part of this portfolio, including any such content uploaded by users. 

We grant the buyer purchasing all artwork an exclusive, royalty-free basis, with no restrictions on the use or reproductions of the designs. 

Upon purchase, we as sole author of the artwork, hereby waive all moral rights on respect to the use to be made of the artwork to which we may be now or at any time in the future be entitled. 

User  acknowledges that we, have not checked throughout the works to ensure that our artwork does not contain anything that is deemed to be indecent, obscene, pornographic, blasphemous, infringing, defamatory, libelous, or otherwise objectionable or unlawful in accordance with the applicable laws. 

User acknowledges that we have not conducted searches of national registers of trademarks throughout the world in relation to specific words, symbols, or numbers forming part of the artwork. We therefore cannot provide any warranties or representations that the artwork will not infringe or otherwise violate any trademarks of any third party; and you must secure every third-party clearance and permission needed in the relevant jurisdiction(s) to enable you to use the specific words, symbols, or numbers forming part of the purchased designs. 

By using the print shop and purchasing any designs, User acknowledges that such content is protected by copyright, trademarks, database rights, and other intellectual property rights. Nothing on this site shall be construed as granting, by implication or otherwise, any license or right to use any trademark, logo, or service mark displayed on the site without the owner’s prior written permission. 

User must not reproduce, modify, copy, distribute, or use for commercial purposes any content without purchase or written permission of Jessica Bucci. 

INDEMNITY

User will indemnify and hold harmless Jessica Bucci from and against any losses, damages, expenses, and other charges (including reasonable fees and expenses of legal and other advisors, court costs, and other dispute resolution costs) incurred by us for any third-party claims arising from or in connection with your use of any purchased artwork. 

SEVERANCE

If one or more of these Terms and Conditions is found to be unlawful, invalid, or otherwise unenforceable, that/those provisions shall be deemed severed from the remainder of these Terms and Conditions (which will remain valid and enforceable).
